Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Savethedate.al ("Savethedate.al," "we," "us," or "our") governing your access to and use of the Savethedate.al website, dashboard, and invitation-hosting services (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms. You are solely responsible for the accuracy of the information you provide and for maintaining the confidentiality and security of your account credentials.

2. The Service

Savethedate.al lets you create, customize, and publish digital invitations, manage guest lists, and collect RSVPs. We may add, change, suspend, or discontinue any feature of the Service, in whole or in part, at any time and without liability to you, though we will make reasonable efforts to notify you of material changes.

3. Acceptable Use

You agree not to, and not to permit anyone else to:

  • Use the Service to send unsolicited bulk messages, spam, or communications outside the scope of a genuine event invitation;
  • Upload, transmit, or share content that is unlawful, fraudulent, harassing, defamatory, obscene, or that infringes or misappropriates any third party's intellectual property, privacy, or other rights;
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • Interfere with, disrupt, reverse engineer, decompile, or attempt to gain unauthorized access to the Service, its underlying systems, or other users' accounts or data;
  • Use any automated means (bots, scrapers, or similar) to access the Service except as expressly permitted;
  • Use the Service in any manner that could disable, overburden, or impair it, or that violates any applicable law or regulation.

We reserve the right, but have no obligation, to monitor, review, remove, or disable access to any content or account that we believe, in our sole discretion, violates these Terms or is otherwise harmful — without notice and without liability to you.

4. Your Content

You retain all ownership rights you already hold in the invitation content, images, audio, and other materials you upload or submit to the Service ("Your Content"). By submitting Your Content, you grant Savethedate.al a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, transmit, and otherwise use Your Content solely as necessary to operate, provide, and improve the Service.

You are solely responsible for Your Content and the consequences of posting or publishing it. You represent and warrant that: (a) you own or have all rights, licenses, consents, and releases necessary to upload Your Content and to grant the license above; and (b) Your Content, and our use of it as permitted by these Terms, does not and will not infringe, misappropriate, or violate a third party's rights or any applicable law. Savethedate.al has no obligation to monitor Your Content and assumes no responsibility or liability for it, including for any loss, corruption, or unauthorized access to Your Content, to the maximum extent permitted by law.

5. Guest Data and RSVPs

When guests respond to your invitation, Savethedate.al processes the information they submit (such as name, RSVP status, and any optional fields you configure) on your behalf and at your direction. As between you and Savethedate.al, you are the data controller for that guest information, and you are solely responsible for having a lawful basis to collect it, for the accuracy of the invitation and any representations made to your guests, and for complying with all applicable privacy and data protection laws. Savethedate.al acts only as a processor of that data and disclaims all liability arising from your collection, use, or handling of guest information. 6. Third-Party Services

The Service may allow you to sign in through, link to, or otherwise interact with third-party services (for example, Google, Apple, Facebook, or Instagram). Your use of any third-party service is governed solely by that provider's own terms and policies. Savethedate.al does not control and is not responsible for any third-party service, and disclaims all liability arising from your use of, or inability to use, any third-party service.

7. Fees and Payment

Certain features may be offered on a paid basis. Where applicable, pricing and billing terms will be presented to you at the time of purchase and are incorporated into these Terms by reference. Except where required by law, all fees are non-refundable. You may cancel a paid plan at any time; cancellation takes effect at the end of the then-current billing period, and no partial-period refunds will be issued unless we state otherwise.

8. Intellectual Property

The Service, including its software, design, text, graphics, and all other content (excluding Your Content), is owned by Savethedate.al or its licensors and is protected by intellectual property laws. Except for the limited right to use the Service as permitted by these Terms, no rights are granted to you, and all rights not expressly granted are reserved.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS. Savethedate.al does not warrant that the Service will meet your requirements, that any content is accurate or reliable, or that any errors will be corrected. You use the Service entirely at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL Savethedate.al, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE — REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED AND EVEN IF Savethedate.al HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Savethedate.al's TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO Savethedate.al FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you, in which case liability will be limited to the fullest extent permitted by applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Savethedate.al and its officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) Your Content; (b) your use or misuse of the Service; (c) your violation of these Terms or any applicable law; or (d) your violation of any rights of a third party, including your guests.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including if we believe you have violated these Terms. You may stop using the Service and delete your account at any time. Upon termination, your right to use the Service will immediately cease; provisions of these Terms that by their nature should survive termination (including Sections 4, 5, 6, 9–14) will survive.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which Savethedate.al is established, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the courts located in that jurisdiction, and you consent to the personal jurisdiction of those courts, except where applicable law requires otherwise.

14. Changes to These Terms

We may update these Terms from time to time in our sole discretion. We will update the "Last updated" date above and, for material changes, provide reasonable notice. Your continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms.

15. Miscellaneous

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms without restriction. These Terms constitute the entire agreement between you and Savethedate.al regarding the Service and supersede any prior agreements.
